 Article 1 : Subject

      "GeneaNet Collections" is a service offered by GeneaNet, a limited company with capital of 223,783 €, having its head office at 44 rue Liancourt 75014 Paris, registered at the Paris RCS under number B 428 812 572, on its website site www.geneanet.org. Part of this service is in free access, the other being for Members (term as defined in article 2 of General Conditions of Use GeneaNet, hereafter called « GCU ») who subscribed specifically for this service.


 Article 2 : Description of Service

      "GeneaNet Collections" (hereafter called the « Service ») allows consultation of various collections of genealogical and historical documents. Access to the Service is free up to a certain level of information. After, it is conditioned to a subscription and purchase of a pack of points (cf. Article 5 hereafter). Complete consultation of a document necessitates utilisation of points puirchased via the Service. However, visitor, not identified and not a subscriber of the Service will be able to make a search amongst the documents proposed by the Service. A certain amount of nominative information will be presented, allowing to decide or not to pursue the search by purchasing points.


 Article 3 : Confidentiality and respect of private life

      Please refer to article 7 of GCU of GeneaNet.


 Article 4 : Application and opposition of Special Conditions of Use

      Present Special Conditions of Use are systematically brought to the attention of each subscriber of the Service "GeneaNet Collections", in order for him to place an order in good conditions. They do not replace nor cancel the GCU of the GeneaNet website (http://www.geneanet.org/cgu.php3) but make up by bringing specific and useful precisions for the utilisation of the Service "GeneaNet Collections".

Consequently, placing an order, implies full compliance without reserve to GCU of the GeneaNet website as well as the present Special Conditions Particulières of Use, excluding all other documents.

All contrary condition made by the subscriber will then, except express acceptance, be inopposable to GeneaNet, whatever the moment it is known.

The fact that GeneaNet does not prevail at a given moment any of the present Special Conditions of Use, cannot be interpreted as renonciation to further prevail to any said conditions.


 Article 5 : Subscription

       5.1. Presentation
         When subscribing to "GeneaNet Collections", the purchaser will become automaticcally member of GeneaNet in the sense of article 2 of GCU of GeneaNet. Subscription and identification conditions on the GeneaNet website, and in particular on "GeneaNet Collections", are described in article 4.2 of GCU.

Consultation of results for "GeneaNet Collections" necessitates a subscription to this Service.

After identification and selection of operations desired, the subscriber makes payment after leaving his coordinates and accepting the GCU and the present Special Conditions of Use.

According to dispositions of Law number 2000-230 dated 13 March 2000 relative to adaptation of right of proof on computer technologies and relative to electronic signature, this positive act of « double click » constitutes irrevocable acceptance by the customer of the GCU and present Special Conditions of Use. This acceptance can only be changed within the limits foressen in the present Special Conditions of Use.

The « double click » associated to the identification procedure constitutes an electronic signature. The latter has same value between the parties as a manual signature.

Un e-mail de suivi de souscription d'abonnement résumant l'inscription est envoyé automatiquement à l'abonné (ci-après désigné l’ « Abonné »). En cas de saisie erronée de l'adresse e-mail, la date effective de début d'abonnement est la date de validation.

Après vérification et validation du paiement, un e-mail confirmant l'autorisation d'accès au service "Les Collections GeneaNet" est envoyé à l'Abonné.

Chaque consultation d'un document ou d'une donnée d'une collection GeneaNet requière l'utilisation d'un nombre variable de points. Pour chaque collection, le nombre de points nécessaires à la consultation finale du document ou de la donnée est clairement indiqué à l'Abonné avant qu'il ne valide sa sélection. Toute sélection validée l'est définitivement et le nombre de points correspondant à cette consultation est alors automatiquement déduit de son capital de points. Si l'Abonné ne dispose pas du nombre de points suffisants pour valider sa sélection, il lui est alors proposé d'acquérir un pack supplémentaire de points parmi les packs disponibles.

Il est précisé qu'aucun document ne sera envoyé à l'Abonné, ni par e-mail, ni par voie postale, la consultation du document se faisant exclusivement en ligne.

Les fac-similés (reproductions certifiées conformes) sont réalisés et livrés à partir de documents originaux de référence. Quelques documents anciens peuvent présenter des défectuosités (taches, etc..) qui ne nuisent pas à leur compréhension ni à l'intérêt de leur contenu. Aucune réclamation ne pourra être recevable à ce sujet, GeneaNet privilégiant dans ce cas, l'information à l'esthétique des documents, souvent anciens.

       5.2. Tariffs and payment conditions
         The subscriber has an account on "GeneaNet Collections". Once identified, the subscriber must purcahse a pack of points in order to view his search results. To this date, there are 3 packs of points :

- the ash-tree pack for 190 points costing 19 €
- the beech-tree pack for 380 points costing 38 €
- the oak pack for 700 points costing 65 €

These prices include VAT at the rate in force at the time the order is placed.

Tariff for subscriptions is that in force on the day subscription is made.

A possible modification of subscrition tariffs has no consequence on the current.

Furthermore, tariffs referred to in the Special Conditions of Use exclude all other costs relative to access to the Internet and in particular, whichever the case may be :

- subscription to Internet providers ;
- cost of telephone calls to the server center ;
- any amount, rent, due, tax or any other remuneration means possibly claimed by online users of the Internet network. These expenses are exclusively at the charge of the subscriber. Bank commissions in case of payment by credit card or bank transfer are exclusively to his charge. Similarly, commissions and/or bank charges in case of payment in euros by cheque are also to the charge of the subscriber.

       5.3. Means and time of payment
         Payment can be made by credit card, by cheque or bank transfer. Payment by credit card online is secure and allows a quick and automatic validation of your purchase.

Other means of payment necessitate manual validation and a longer time between payment and validation of your purchase. For bank transfer, this can be up to 10 days, taking into account transmittal of credit advice from the bank to GeneaNet.

            5.3.1 - By credit card:
               According to one of the following possibilities chosen by the subscriber :

- typing the number of credit card directly on the Internet website (via our partner the CIC bank who garantees a secure treatment),
- by mail : GeneaNet - 44 rue Liancourt - 75014 Paris - France,
- by fax : 01 42 74 51 50.

            5.3.2 By bank or postal cheque made payable to GeneaNet :
               - solely in a currency currently legal on the French national territory,
- within a maximum of 15 work days since subscription date.

All credit cards with Carte Bleue (CB), Visa, Eurocard and/or Mastercard are accepted.

            5.3.3 : By bank transfer
               Settlement can be made by bank transfer to the bank account of GeneaNet of which details are :

When ordering on line, an order reference will be indicated to you. This reference will also be reminded in the confirmation email you will receive. This reference must be indicated by you when payment by bank transfer is made.

In the case of bank transfer, all bank charges will be at your expense. Subscription will be valid only when the exact amount for the pack is credited on GeneaNet account. You are invited to enquire with your bank about the possible bank charges.

       5.4 : Payment incidents
         In case GeneaNet does not receive or cash the payment, access authorisation to the selected documents or data will not be made.

       5.5 : Cancellation and refund
         Cancellation and refund of subscription will only be made if no unit has been used and maximum 15 days after validation date. Any utilisation of units commits the user and cancels any refund. All refund claims exceeding 15 days of subscription will not be taken into account. Cancellation of subscription in case of non-utilisation of units is effective upon receipt of your email or mail. The user must foresee 30 days before refund is made and 5 euros for administrative costs.

Refund by GeneaNet will be made via the same method of payment as used by the subscriber. In case of refund by bank transfer, all bank charges will be at the expense of the subscriber.

Purchase of a pack of points is not transferable nor exchangeable. Each purchase of pack is allocated to one and only account. It will not be possible to modify this allocation of a pack or one or several points from one account to another.


 Article 6 : License and rights for reproduction and utilisation

      To access the website, GeneaNet consent the subscriber, who accepts, a licence in the following conditions :

- The subscriber is authorized to use freely all information contained in the documents of the Service "GeneaNet Collections".
- The subscriber is authorized to integrate in his own genealogy information provided by documents consulted on the Service "GeneaNet Collections".

This licence gives the user a right of private usage, non collective and non exclusive, on documents consulted on the Service "GeneaNet Collections". It includes the right of representation on screen and reproduction, in one copy only, for saving purposes. All placement in a network, all broadcast, under any form, even partial, of the document is therefore forbidden.

En d'autres termes, le contenu des documents est libre de droit tandis que le document (c'est-à-dire l'image) ne l'est pas.

Ce droit est personnel, il est réservé à l'usage exclusif et non collectif de l’Abonné. Il n'est transmissible en aucune manière.

Tout autre usage est soumis à autorisation préalable et expresse.

La violation de ces dispositions impératives soumet le contrevenant, et toutes personnes responsables, aux peines pénales et civiles prévues par la loi.


 Article 7 : Claims

      In order to allow the widest reactivity in the treatment of possible claims, the Service "GeneaNet Collections" has put in place a form for that purpose. All claim regarding utilisation of the Service "GeneaNet Collections" will have to be addressed to GeneaNet exclusively with this form, accessible from pages "History of your orders".

GeneaNet commits itself to give the subscriber a reply within 48 worked hours following this claim.

All claim sent to GeneaNet by any other means (fax, mail, email) will be ignored.


Present Special Conditions of use of the Service "GeneaNet Collections" are governed by the French Law. Except for contrary dispositions of a public nature, all dispute relative to validity, interpretation or execution of the present conditions will be submitted to the competent Paris court of justice.
